There are many legal protections for LGBTQ+ students in place on the local (OUSD), state (California), and federal levels. In addition, Oakland Unified School District has committed to providing a positive school environment for LGBTQ+ students, which means that they recognize the right of every student to be respected. What if there is a problem?
If you feel these laws are not being followed and that your rights have been violated, report the incident(s) to your school’s administrators (principal, assistant principals, and/or Title IX Ombudsperson / coordinator) immediately.
- It can feel scary to speak up, but it is your right to be safe at school!
Other students may also be negatively impacted, so addressing the problem could make a bigger positive change than you might imagine. - Not everyone is aware of the policies and protections in place; if your administrative team isn’t knowledgeable, responsive, or helpful please speak with your GSA or Rainbow Club liaison for assistance.
- Instances of bullying and misgendering should receive immediate support from your school administrators; if not, reach out to the district by contacting Schmian Evans, who is our district’s specialist for LGBTQ+ programming and support.
- It’s critical that you keep track of every step and conversation in writing, including dates and names when possible. If a Title IX complaint becomes necessary you will be required to show how and when your school administrators were looped in. Title IX complaints must be filed within 6 months of an incident.
- If you are worried about retaliation or preserving anonymity, ask your GSA or Rainbow Club liaison for help or connect directly with Schmian Evans.
